First DUI, and loss of points loss.

Postby fool » August 28th, 2013, 8:09 pm

Hi, i'm in a desperate situation.
I live in Brisbane, and the other day I got pulled over for 89 in a 60 zone, i honestly did not realize i was speeding and upon re-checking the site the limit had only just dropped. The problem is i had a few drinks, and i've been charged with dd on the same stop. I blew .069 on the road and .056 in the station.
I've only just realised that i had accumulated 10 demerit points up until that incident already, so the speeding fine alone will result in a loss of licence. I have also lost my licence in mid 2011 for accumulation of points.
My job requires me to be on the road, and i travel to up to 10 jobs a day, so i'm constantly driving. The accumulation of points were mostly 13kmh over the limit, and most while driving between jobs. I am a safety minded person and although i was speeding and over the limit, i honestly would never put anyone at risk. I made a conscious decision before i jumped in the vehicle that i was under the limit and ok to drive. I was also counting my drinks, but as i have no learnt the method i believed to be true was in fact incorrect.
The problem is, in qld if you have had your licence suspended in the 5 years prior to the offence, you are not eligible for a work licence. As mentioned earlier, i had mine suspended for 3 months in 2011 for accumulation of points.

My job supports my father and mother. It keeps the mortgage payments happening. literally. and if i cant get to work, i loose my job. I dont know what to do, i'm sick in the stomach and i cant sleep. Does anyone have any advice, i'm trying to get a hold of the qp9 (police statement in court) ASAP and i'll be getting my traffic history tomorrow to show a duty solicitor (paying for one will cause financial trouble, and i'm not sure if its comparably beneficial.)

Any advice on what to say to the judge? All i have is the truth, and my desperation.
Thank you in advance
fool
