Drug Driving Greensborough (VIC)

I have been charged with drug driving. At the time the police carried out the test, I did not feel drug affected and my driving was normal. I was told by police that my license would be disqualified. Is this correct? A mate of mine was recently charged with the same offence and avoided licence loss.

I need my licence for work, so any advice would be appreciated.

Depending upon the offence you happen to be charged with, the police don't necessarily have to establish your driving was impaired by earlier drug use. It is sufficient that the drug test reveals the presence of a prescribed drug in your system. The offence initially gave a Magistrate a choice as to whether to impose a disqualification (so discretionary licence loss), the law was amended in December in December 2010 and as a result, any offences from that date now attract mandatory licence loss.
