Convicted for drink driving thru CCTV footage alone?

Postby Mitman » October 8th, 2013, 8:44 pm

Hi,

Can someone be prosecuted for drink driving through CCTV evidence alone? I.E recorded coming out of a club then driving with no follow up by police until a week later?

If not can u also be convicted of dangerous driving thru the CCTV evidence alone? I.E erratic driving on the same footage?

I cannot seem to find an answer to this no matter where I look :(

Thanks in advance

Hi Mitman,

I will be able to answer any questions you may have about this matter. Just let me ask you first, is this matter a NSW matter?

Hi,

Thanks for the quick reply, sorry I never mentioned, this is actually regarding WA but I guess it would be good to know if different states having different laws / opinions on this as I simply cannot find any documentation about it for anywhere.

Hope you can still help

It is certainly the case that the laws will differ from state to state.

However, if you would like to give me a call on 02 9261 4555 I may be able to answer any of your preliminary questions regarding procedure, and direct you to a more appropriate area to find the information you are seeking.
