Hello, I have just been charged with my third mid range offence
1st 2008 6 month suspension
2nd April 2014 8 month suspension
3rd nov 2015

I am from nsw am wondering what outcome is most likely, circumstances are that I drank the night before, slept for 6-7 hrs and drove because I felt fine.
Reading was .106
Would like to know what steps I can take, have been told the sober drivers program would be good and that I should have an alcohol interlock system but of course most concerned about any sort of custodial centence
Thank you

Hi Spinal29,

This is certainly something that I can assist you with. Before I give you any advice, I understand that you say you are from NSW, did the offence occur in NSW?

Thanks Spinal29.

The outcome will depend on a variety of factors including: the penalties you received previously, your traffic record otherwise, the circumstances of the offence and any subjective material we can gather for your for Court.

From what you have told me, I anticipate there will be a further disqualification period, and then the Magistrate will order that you have the Interlock device installed in your car. This is mandatory now for all second drink driving offences within five years. You will be looking at a fine, and very likely further penalties as well.

If you wish to speak further about the matter, please give me a call on 02 9261 4555 and I can speak to you further about the matter.
