low value PCA - International license

Postby prash90 » May 17th, 2015, 8:10 pm

Hello
I was pulled over by cops the other night and my level of alcohol was 0.0054. which was recorded as low level pca and i was asked to see magistrate on 5th of june. I am holding a international drivers license.

The police gave my license back and he told me i might get my license suspended for 3 months or fined. on my way back i explained the same thing to taxi driver and he told me that my level of alcohol (0.0054) is really low and i could get a section 10. as it was my first offence. could any one please tell me if i could get section 10? what kind of measures should i take now

any kind of help would be greatly appreciated

best regards

Hi Prashanth,

Before I can give you any advice, can I ask if this offence occurred in NSW?

Thanks Prashanth,

A section 10 is a sentencing option for the Magistrate. Effectively, it is a finding of guilt without proceeding to a conviction. If you are not convicted you cannot be fined or disqualified from driving either.

When considering a section 10, the Court takes into account a number of factors, such as the person's age, traffic record and history and their general character. I would also strongly suggest attendance at a Traffic Offenders Program and obtaining character references for your sentencing hearing.

If you would like to give me a call on (02) 9261 4555 I would be happy to assist you and provide further information based on your individual circumstances
