Hi, on Saturday night I blew 0.053 and was given a court hearing form where I can plead guilty or not guilty. It's my first traffic offence and the officer said I have a good chance at getting a section 10. What should I do?

I was driving when I saw a random breathe test on the side of the road. I turned into a bus lane (not knowing it was a bus lane) when a police car pulled me over and I blew 0.053.

I work as a consultant, so I occasionally need my car to travel to clients. I also live far away from public transport so it would take me about 2 hours to travel to work. Additionally it would be very difficult to find future employment in my field with a criminal record. I've obtained character references from my girlfriend (who was in the car with me) and a former boss. I haven't obtained any references from my work place because I don't want anyone at work to know about it. The police papers said i was remorseful for my actions. Is there anything else I can do to improve my chances of a section 10?

Hi Mdory,

When considering a section 10, the Court takes into account a number of factors, such as the person's age, traffic record and history and their general character.

If you would like to give me a call on (02) 9261 4555 I would be happy to assist you and provide further information based on your individual circumstances.
